Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of trachthouse.com (the “Site”) and any purchase you make from TrachtHouse. The Site and store are operated by Kabinat LLC, a Wyoming limited liability company, 30 N Gould St, Ste N, Sheridan, WY 82801, USA (“TrachtHouse”, “we”, “us”). By using the Site or placing an order you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. If you create an account you are responsible for keeping your login details confidential and for activity under your account.

2. Products and descriptions

We describe and photograph our products as accurately as we can. Genuine leather is a natural material, so small variations in color, grain and texture are normal and are not defects. Colors can also look different depending on your screen. Sizes and measurements given on product pages are approximate.

3. Prices and payment

Prices are shown in US dollars. Sales tax and shipping are added at checkout where applicable. We may change prices at any time, but changes do not affect orders already confirmed. Payment is taken when you place your order and is processed by our payment providers.

4. Orders

Your order is an offer to buy. We accept it when we ship the item or send a shipping confirmation. We may refuse or cancel an order, for example if an item is out of stock, if there is an obvious pricing or description error, or if we suspect fraud. If we cancel after payment, we refund you in full.

5. Made-to-measure items

Made-to-measure items are made from the measurements and choices you confirm with us. Please check them carefully; we are not responsible for fit issues caused by incorrect measurements provided to us. Made-to-measure items cannot be returned or exchanged unless they are faulty or not made to the agreed specification. Production times are estimates confirmed before payment.

6. Shipping, returns and refunds

Delivery is covered by our Shipping Policy and returns, exchanges and refunds by our Returns & Exchanges Policy, both of which form part of these Terms. Risk of loss passes to you when the item is delivered to the address you provided.

7. Promotions and discount codes

Promotions and discount codes are subject to their stated conditions, cannot be exchanged for cash, and may be withdrawn at any time. Unless stated otherwise, only one code can be used per order.

8. Reviews and content you submit

If you submit reviews, photos or other content, you confirm that it is your own and lawful, and you grant us a non-exclusive, royalty-free license to use, display and reproduce it in connection with the Site and our marketing. We may remove content at our discretion.

9. Intellectual property

All content on the Site, including text, photographs, graphics, logos and the TrachtHouse name, is owned by or licensed to us and protected by intellectual property laws. You may not copy or use it for commercial purposes without our written permission.

10. Acceptable use

You agree not to misuse the Site, including attempting to gain unauthorized access, interfering with its operation, scraping it on a large scale or using it for unlawful purposes.

11. Warranties

Products come with any warranties that cannot be excluded under applicable law. Otherwise, to the fullest extent permitted by law, the Site and products are provided “as is” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Normal wear, improper care and alterations are not defects.

12. Limitation of liability

To the fullest extent permitted by law, Kabinat LLC is not liable for indirect, incidental, special or consequential damages arising from your use of the Site or our products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to indemnify Kabinat LLC against claims arising from your breach of these Terms or your misuse of the Site.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction, except where the law of your place of residence gives you the right to bring proceedings elsewhere. Please contact us first so we can try to resolve any issue directly.

15. Changes

We may update these Terms from time to time. The version in force when you place an order applies to that order.
